Ember Terms of Use

These Terms of Use are a legal agreement between you and EventMedConnect ("EventMedConnect", "we", "us") governing your use of the Ember mobile application ("Ember" or the "app"). By downloading, accessing, or using Ember, you agree to these terms. If you do not agree, do not use the app.

1. Eligibility

You must be at least 18 years old to use Ember. By using the app you confirm that you are 18 or older and that you are able to enter into a binding agreement.

2. Your licence to use Ember

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use Ember on devices you own or control, solely for your own personal, non-commercial use, and in accordance with these terms and the app store's rules.

You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract the source code of the app, except to the extent this restriction is prohibited by applicable law.

3. Not medical or professional advice

Ember is a self-reflection and journaling tool designed to support wellbeing. It is not a medical device and does not provide medical, psychological, therapeutic, or other professional advice, diagnosis, or treatment. Ember is not a substitute for care from a qualified professional.

Always seek the advice of a qualified health provider with any questions about your health or wellbeing. If you are in crisis or believe you may be a danger to yourself or others, contact your local emergency services or a crisis line immediately. Do not rely on Ember in an emergency.

4. Your content

You retain ownership of everything you write in Ember, including your Sparks, reflections, intentions, debriefs, and Friday reflections ("your content"). This content is stored locally on your device and is not uploaded to us, except where you voluntarily include it in a bug report or feature request you submit. You are responsible for your content and for keeping your own backups, as we cannot recover content stored only on your device.

5. Subscriptions, free trials, and billing

Ember offers an optional premium subscription ("Ember Pro") on a monthly or yearly basis, and may offer a free trial. Subscriptions are sold and processed through the Apple App Store or Google Play, subject to their terms.

  • Payment is charged to your Apple or Google account at confirmation of purchase, or at the end of any free trial.
  • Subscriptions renew automatically for the same period and price unless you cancel at least 24 hours before the end of the current period.
  • If you start a free trial and do not cancel before it ends, it automatically converts to a paid subscription and your account is charged.
  • You can manage or cancel your subscription, and turn off auto-renewal, in your Apple App Store or Google Play account settings at any time.
  • Prices may vary by region and are shown in the app before purchase. We may change prices for future billing periods; changes do not affect a period you have already paid for.

Except where required by law or the app store's policies, payments are non-refundable and partial periods are not refunded. Refund requests are handled by Apple or Google according to their policies.

6. Acceptable use

You agree not to:

  • Use Ember for any unlawful purpose or in violation of these terms.
  • Interfere with, disrupt, or attempt to gain unauthorised access to the app or its systems.
  • Use the app in any way that could damage, disable, or impair it, or circumvent its security or access controls.

7. Intellectual property

Ember, including its name, design, mascot, text, graphics, and software, is owned by EventMedConnect or its licensors and is protected by intellectual property laws. Except for the licence granted to you above, these terms do not transfer any rights in the app to you.

8. Disclaimers

The app is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that defects will be corrected. Nothing in these terms limits rights you may have as a consumer that cannot be excluded under applicable law.

9. Limitation of liability

To the fullest extent permitted by law, EventMedConnect will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or relating to your use of, or inability to use, the app. To the fullest extent permitted by law, our total liability for any claim relating to the app will not exceed the amount you paid us for the app in the 12 months before the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

10. Termination

You may stop using Ember at any time and delete the app. We may suspend or terminate your access if you breach these terms or if we discontinue the app. Provisions that by their nature should survive termination — including ownership, disclaimers, and limitation of liability — will continue to apply.

11. Apple and Google app stores

These terms are between you and EventMedConnect, not with Apple or Google. Apple and Google are not responsible for the app or its content. Where you obtained the app through the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You agree to comply with the applicable app store's terms of service.

12. Changes to the app and these terms

We may update the app and these terms from time to time. When we make material changes to these terms, we will update the date above and, where appropriate, notify you in the app. Your continued use of Ember after an update means you accept the revised terms.

13. Governing law

These terms are governed by the laws of Ireland, without regard to its conflict of law rules, and the courts of Ireland will have jurisdiction over any dispute, except where mandatory consumer protection laws of your country of residence provide otherwise.
